The Ministry of Labour, Training and Skills Development updated its Employment Standards Policy & Interpretation (P&I) Manual on January 24 with the following changes:
- The Program Policy regarding the scope of the “Primary Production” exemption was changed to incorporate the Divisional Court’s Rouge River Farms decision: s. 2(2) of O. Reg. 285/01.
- Additional discussion has been added regarding the “Fresh Fruit and Vegetable Processing” special overtime threshold: s. 15 of O. Reg. 285/01.
- The discussion of the poster provisions in s. 2(5) has been updated to specifically state that employers are only required to provide each employee with the poster once.
The P&I Manual explains how the ministry interprets, administers and enforces the Employment Standards Act, the Employment Protection for Foreign Nationals Act, and their associated regulations. The manual is available at Ontario.ca/labour. Updates are made as required.
