The Ministry of Labour, Training and Skills Development updated its Employment Standards Policy & Interpretation (P&I) Manual on January 24 with the following changes:

  1. The Program Policy regarding the scope of the “Primary Production” exemption was changed to incorporate the Divisional Court’s Rouge River Farms decision: s. 2(2) of O. Reg. 285/01.
  2. Additional discussion has been added regarding the “Fresh Fruit and Vegetable Processing” special overtime threshold: s. 15 of O. Reg. 285/01.
  3. The discussion of the poster provisions in s. 2(5) has been updated to specifically state that employers are only required to provide each employee with the poster once.

The P&I Manual explains how the ministry interprets, administers and enforces the Employment Standards Act, the Employment Protection for Foreign Nationals Act, and their associated regulations. The manual is available at Updates are made as required.
